The Beaumont Enterprise, Public Notice – Overall Disadvantaged Business Enterprise Goal, Fiscal Years 2014 through 2016 In accordance with Title 49 Code of Federal Regulations (C.F.R.), Part 26, recipients of federal-aid funds authorized by the Transportation Equity Act for the 21st Century (TEA 21) are required to establish Disadvantaged Business Enterprise (DBE) programs. Title 49 C.F.R. §26.45 requires the recipients of federal funds, including the Texas Department of Transportation (department), to set an overall goal for DBE participation in U.S. Department of Transportation assisted contracts. As part of this goal-setting process, the department is publishing this notice to inform the public of the proposed overall goal, and to provide instructions on how to obtain copies of documents explaining the rationale for the goal. The proposed overall DBE goal for Fiscal Years 2014 - 2016 is 11.7%. The proposed goal and goal-setting methodology are available for inspection between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, for 30 days following the date this notice is published. The meeting will be held in the City Council Chambers, City Hall, 801 Main Street, Beaumont, Texas. The purpose of this hearing is discussion of the Fiscal Year 2014 Proposed Budget and Capital Program. The Beaumont Enterprise, Final Notice and Public Explanation of a Proposed Activity in a Wetland To: All interested Agencies To: All interested Agencies, Texas General Land Office (TGLO), the US Department of Housing and Urban Development, US Environmental Protection Agency (EPA), U.S. Fish and Wildlife Service, US Geologic Service Water Resource Division, United States Coast Guard, Regional Flood Management Association, United States Army Corp of Engineers, U.S. Department of Housing and Urban Development (HUD), Texas Water Development Board, Texas Parks and Wildlife Department, Texas Commission on Environmental Quality, Jefferson County, Jefferson County Drainage District, South East Texas Regional Planning Commission Jefferson County Water Control and Improvement, Citizens of the City of China, Groups and Individuals. This is to give notice that Responsible Entity under Part 58 has conducted an evaluation as required by Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Wetland Management, to determine the potential affect that its activity in the wetland will have on the human environment for Sewer Facilities- 1b under contract numbers DRS220257 and Texas General Land Office (TXGLO) contract No.13-291-000-7544 for the City of China, Jefferson County, TX. As a result of Hurricane Ike on September 13, 2008, the City of China sustained flooding by hurricane winds, storm and tidal surge resulting in loss of normal electrical power service for several days. The failure of the facilities to function threatened the public health, safety, and welfare of all served by these facilities due to the build-up of untreated sewage. Project 22311.1-1/CE The City of China shall purchase and install valve vaults, electrical controls and pumps to rehabilitate lift station #8. Improvements will ensure continuous operation of the lift stations and uninterrupted sewage treatment at Lift Station #8 S. Broadway, approximately 1000 ft south of Wilson Avenue. The size and footprint of the area within a wetland is 100 sq ft. and the natural values are within a residential and commercial area. This project is within the City of China, which is located in Jefferson County, Texas. The City of China has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values and reasons for non-selection. Alternatives include 1) Not performing this rehabilitation would not address the threat to public health, safety and welfare of those impacted by the potential buildup of untreated sewage. 2) Moving this project to another location would not address the problems occurring at this location and would not be cost effective. 3) Utilizing engineering wetland mitigation measures like limiting access to wetland areas and staying within the existing footprint of the lift station causes minimal short term impacts yet preserves the natural and beneficial values while addressing failing lift station function. The project will ensure FEMA applicable compliance with state and local wetland protection procedures. The City of China has reevaluated the alternatives to building in the wetland and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments. This activity will have no significant impact on the environment for the following reasons: 1) Not performing this rehabilitation would not address the threat to public health, safety and welfare of those impacted by the potential buildup of untreated sewage. 2) Moving this project to another location would not address the problems occurring at this location and would not be cost effective. 3)The activities identified to address the problems at the lift station ensure the human health. Engineering best management practices to include silt fencing and ensuring the area is returned to preconstruction conditions will facilitate preservation of the wetland and restore and or preserve the values of the wetlands. There are three primary purposes for this notice. First, people who may be affected by activities in wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information about wetlands can facilitate and enhance Federal efforts to reduce the risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in wetlands, it must inform those who may be put at greater or continued risk.
